އދ. ދިގުރަށުގައި ބިދޭސީ މަސައްކަތްތެރިން ދިރިއުޅޭ ތަނެއްގައި ދާދިފަހުން ހިނގި އަލިފާނުގެ ހާދިސާއާ މެދު، މި ބަޔާނުގައި ސޮއިކުރާ ޖަމްއިއްޔާތަކުން ނުހަނު ކަންބޮޑުވުން ފާޅުކުރަމެވެ. މި ހާދިސާގައި ފަސް މީހެއްގެ ފުރާނަ ގެއްލިގެންގޮސްފައިވާއިރު އިތުރު ދެ މީހަކަށް ދަނީ ސީރިއަސް ހާލަތުގައި ވެންޓިލޭޓަރުގައި ފަރުވާދެމުންނެވެ. މި ހާދިސާގައި ނިޔާވި ފަރާތްތަކުގެ އާއިލާތަކަށާއި، މިކަމުގެ އަސަރު ފޯރި އެންމެހާ ފަރާތްތަކަށް މިޖަމްއިއްޔާތަކުން އިޚްލާސްތެރިކަމާއެކީ ތަޢުޒިޔާ ރައްދުކުރަމެވެ.

މިހާދިސާއަކީ ތަކުރާރުކޮށް ބިދޭސީ މަސައްކަތްތެރިންގެ ސަލާމަތާއި ރައްކާތެރިކަމަށް އަޅާނުލާ ދޫކޮށްލުމާއި، ރައްކާތެރި ދިރިއުޅޭނެ މާހައުލާއިި މަސައްކަތުގެ މާހައުލު ކަށަވަރުކޮށްދޭންޖެހޭ ފަރާތްތަކުން ޒިންމާދާރުކުރުވުން ކުޑަވުމުގެ އާދައެއް ނުވަތަ ޕެޓާރން އެއްގެ ސަބަބުން ކުރިމަތިވާ މިފަދަ ހާދިސާތަކުގެ ތެރޭގައިި އަނެއްކާވެސް ހިމެނޭ ހާދިސާއެކެވެ. އޭގެ ނަތީޖާއެއްގެ ގޮތުން، އިންސާފު ނުލިބޭ ނިޒާމެއްގެ ތެރޭގައި، ބިދޭސީ މަސައްކަތްތެރިންގެ ދިރިހުރުމުގެ ހައްގާއި، ސަލާމަތްތެރިކަމާއި އެކު މަސައްކަތްކުރުމާއި، އިންސާނީ ކަރާމާތް ދަނީ އަބަދުވެސް ގެއްލެމުންނެވެ. ތޮއްޖެހިފައިވާ ތަންތަނުގައި ދިރިއުޅޭ ބިދޭސީ މަސައްކަތްތެރިންނަށް ކުރިމަތިވާ ނުރައްކާތައް 2022 ވަނަ އަހަރު މާލޭގައި ހިނގި ނުރައްކާތެރި އަލިފާނުގެ ހާދިސާއިންވެސް ވަނީ ހިތާމަވެރި ގޮތަކަށް ސާފުވެފައެވެ. އެ ހާދިސާގައި، ގަރާޖެއްގެ މަތީގައި ހުރި، ވައި ދައުރުވުން ކުޑަ، ތޮއްޖެހިފައިވާ ކޮޓަރިތަކެއްގައި ދިރިއުޅެމުންދިޔަ 10 ބިދޭސީއަކު ވަނީ ނިޔާވެފައެވެ. 2024 ވަނަ އަހަރު ގާމަގު ކެފޭގައި ހިނގި އަލިފާނުގެ ހާދިސާ މަތީ ފަންގިފިލާތަކުގައި ހުރި ދިރިއުޅޭ ބައިތަކަށް ފެތުރިގެން ދިޔުމުގެ ސަބަބުން 57 މީހަކަށް އަސަރުކޮށް، 50 އަށްވުރެ ގިނަ ބިދޭސީން ހާލުގައި ޖެހުނެވެ. އޭގެ ކުރިން 2023 ވަނަ އަހަރު، ނީލަން ފިހާރައިގައި ހިނގި އަލިފާނުގެ ހާދިސާގައި ބިދޭސީން ދިރިއުޅޭ ބްލޮކެއް އެއްކޮށް އަނދައި، 166 މަސައްކަތްތެރިން ހާލުގައި ޖެހުނެވެ. މީގެ އިތުރުން ވެސް، ރާއްޖޭގެ އެކި ކަންކޮޅުތަކުގައި ބިދޭސީން ދިރިއުޅޭ ތަންތަނާއި މަސައްކަތްކުރާ ތަންތަނުގައި ހިނގާފައިވާ އަލިފާނުގެ ހާދިސާތަކުން ސަލާމަތީ ކަންކަން ބެލެހެއްޓުމުގައި ހުރި ކަންބޮޑުވުންތަކަށް އެކަށީގެންވާ ހައްލެއް އަދިވެސް ލިބިފައި ނުވާކަން ދޭހަވެއެވެ.

ބިދޭސީ މަސައްކަތްތެރިން ގެންގުޅޭ ފަރާތްތަކުން އެފަރާތްތަކަށް ދިރިއުޅުމަށް ހަމަޖައްސައިދީފައި ހުންނަ އެކޮމޮޑޭޝަންއަކީ ގިނަ ފަހަރަށް އިންސާނުން އުޅެން އެކަށީގެންނުވާ އަދި ސާފުތާހިރުކަމުގެ ވަސީލަތްތަކެއް ނެތް، ތޮއްޖެހިފައިވާ ތަންތަނެައެވެ. އަދި ނުރައްކާތެރި އިމާރާތްކުރާ ސައިޓުތަކާއި، ގަރާޖު، ކެފޭ، ނުވަތަ ގުދަން ފަދަ ތަންތަނުގެ މަތީގައި ހުންނަ ހަނި ގޮޅިތަކުގެ އިތުރުން ނުރައްކާތެރި ސާމާނާއި ސިނާއީ ކެމިކަލް ފަދަ ތަކެތި ރައްކާކޮށްފައި ހުންނަ މަސައްކަތު މާހައުލުތަކުގައި ދިރިއުޅެން އެތައް ބިދޭސީ މަސައްކަތްތެރިންނަަށް ވަނީ މަޖުބޫރުވެފައެވެ.

ވަޒީފާދޭ ފަރާތުގެ މުވައްޒަފުން ދިރިއުޅުމަށް ހަމަޖައްސާ ތަންތަނުގެ އާންމު މިންގަނޑުތަކުގެ ގަވާއިދު (ރ-2021/15) ގައި، މީހުން ދިރިއުޅޭ ތަންތަނުގައި ހުންނަންޖެހޭ ފެންވަރާއި، ވައި ދައުރުވުމާއި، މީހުން ބޭތިއްބޭނެ އެންމެ ގިނަ އަދަދާއި، އަދި ސާފުތާހިރުކަމުގެ މިންގަނޑުތައް ސާފުކޮށް ބަޔާންކޮށްފައިވެއެވެ. މީގެ އިތުރުން، އަލިފާނުގެ ހާދިސާތަކުން ރައްކާތެރިވުމާއި ކުއްލި ހާލަތްތަކުގައި އަމަލުކުރާނެ ގޮތުގެ އުސޫލުތަކުގެ ތެރޭގައި، އެކަށީގެންވާ އަލިފާން ނިއްވާ ސާމާނު ހުރުމާއި، ފަސޭހައިން ނުކުމެވޭނެ ގޮތަށް ހުންނަ ސަލާމަތީ މަގުތަކާއި، އަލިފާނުގެ ނުރައްކާ ކުޑަކުރުމަށް އަޅަންޖެހޭ ފިޔަވަޅުތައް މި ގަވާއިދުގައި ހިމެނެއެވެ. ހަމަ އެފަދައިން، މަސައްކަތުގެ މާހައުލުގެ ސަލާމަތާއި ސިއްހީ ރައްކާތެރިކަމުގެ ގާނޫނު (ގާނޫނު ނަންބަރު: 2/2024) އިން ވެސް، ނުރައްކާތަކުން ސަލާމަތްވުމަށާއި ރައްކާތެރި މާހައުލެއް ކަށަވަރުކޮށްދިނުން ލާޒިމުކުރެއެވެ. އެހެންނަމަވެސް، މި ގާނޫނުތަކާއި ގަވާއިދުތައް ތަންފީޒުކުރުމުގައި ހުރި ބަލިކަށިކަމާއި، މޮނިޓަރކޮށް ބެލެހެއްޓުމުގެ ނިޒާމުގައި ހުރި އިހުމާލުތަކުގެ ސަބަބުން، މިންގަނޑަށް ނުފެތޭ އަދި އިންސާނީ ކަރާމާތް ގެއްލޭ ފަދަ ތަންތަން އަދިވެސް ދަނީ އާންމުކޮށް ބޭނުންކުރަމުންނެވެ. މީގެ ނަތީޖާއެއްގެ ގޮތުން، ބިދޭސީ މަސައްކަތްތެރިންނަށް އަނިޔާވުމާއި ފުރާނައަށް ގެއްލުންވުމުގެ ނުރައްކާ އަދިވެސް އޮތީ ނުހަނު ކަންބޮޑުވާ މިންވަރުގައެވެ.

ކޮންމެ މަސައްކަތްތެރިއަކަށްވެސް ސަލާމަތާއި، ކަރާމާތާއި، އަދި އިންސާފު ލިބުމުގެ ހައްގު ލިބިގެންވެއެވެ. ނަމަވެސް، ތަކުރާރުވަމުންދާ މިފަދަ ހާދިސާތަކުން ހާމަވަނީ، މަސައްކަތްތެރިންގެ ހައްގުތަކަށް އާންމުކޮށް އިހުމާލުވަމުންދާ ކަމާއި، ޒިންމާދާރުކުރުވުމުގެ ފިޔަވަޅުތައް އެޅޭލެއް މަދުކަމެވެ. ހުރިހާ މަސައްކަތްތެރިންނަކީވެސް ރައްކާތެރި މާހައުލެއްގައި ދިރިއުޅޭ އަދި މަސައްކަތްކުރާ ބއެއްކަންް ކަށަވަރުކުރުމަކީ، ގައުމީ އަދި ބައިނަލްއަގުވާމީ ގާނޫނުތަކުގެ ދަށުން ދައުލަތާއި ވަޒީފާދޭ ފަރާތްތަކުގެ މައްޗަށް އޮތް ސާފު ޒިންމާއެކެވެ. އިންސާފު ގާއިމުކުރެވޭނީ ބިދޭސީ މަސައްކަތްތެރިންގެ ހައްގުތައް ރައްކާތެރިކޮށް، ގާނޫނާ ޚިލާފުވާ ފަރާތްތަކާއި ދެކޮޅަށް ދައުވާކޮށް ގާނޫނީ ފިޔަވަޅުއަޅައި، އެކަށީގެންވާ ބަދަލު ހޯދައިދީ، އަދި ކުރިމަގުގައި މިފަދަ ހާދިސާތައް ހުއްޓުވުމަށްޓަކައި ހަރުދަނާ ފިޔަވަޅުތަކެއް އެޅިގެންނެވެ.

މަތީގައި ބަޔާންކޮށްފައިވާ ކަންކަމަށް ރިއާޔައްކޮށް މިޖަމްއިއްޔާތަކުން އަންނަނިވި ކަންކަމަށް ގޮވާލަމެވެ:

މޯލްޑިވްސް ޕޮލިސް ސަރވިސް ހިމެނޭހެން ކަމާބެހޭ އިދާރާތަކުން، ދިގުރަށުގައި ހިނގި އަލިފާނުގެ ހާދިސާގެ އިތުބާރު ހުރި، ދެފުށް ފެންނަ އަދި ހާމަކަންބޮޑުގޮތަކަށް ތަހުގީގު ހިންގުމަށާއި، މި ހާދިސާ ހިނގަން މެދުވެރިވި ސަބަބުތަކާއި، ސަލާމަތީ މިންގަނޑުތަކަށް އަމަލުކޮށްފައިވާ މިންވަރު ފުރިހަމައަށް ބެލުމަށް.
ދައުލަތާއި ކަމާބެހޭ މުއައްސަސާތަކުން، މި ހާދިސާގައި ނިޔާވި ފަރާތްތަކުގެ އާއިލާތަކަށް ފުރިހަމަ އަދި އިންސާފުވެރި ބަދަލެއް ލިބޭނެކަން ކަށަވަރުކުރުމަށާއި، އެންމެހައި ހަރަދުތަކެއް ލަސްނުކޮށް ހަމަޖައްސައިދިނުމަށް.
ދައުލަތާއި ކަމާބެހޭ މުއައްސަސާތަކުން، އިހުމާލުވި ހުރިހާ ފަރާތްތަކަކާ މެދު ގާނޫނީ ފިޔަވަޅު އަޅައި، އެ ފަރާތްތައް ފުރިހަމައަށް ޒިންމާދާރުކުރުވުން ކަށަވަރުކުރުމަށް.
ލޭބަރ ރިލޭޝަންސް އޮތޯރިޓީއިން، ބިދޭސީ މަސައްކަތްތެރިން ދިރިއުޅޭ ތަންތަން މޮނިޓަރކުރުމުގައި މިހާރަށްވުރެ ބޮޑަށް އިސްނަގައިގެން މަސައްކަތްކުރުމަށާއި، ނުރައްކާ ބޮޑު ތަންތަނަށް އިސްކަންދީ، މިންގަނޑުތަކާ ހިލާފުވާ ތަންތަނާ މެދު ވަގުތުން ފިޔަވަޅު އެޅުމަށް.
ހިއުމަން ރައިޓްސް ކޮމިޝަން އޮފް ދަ މޯލްޑިވްސްއިން މި ހާދިސާއާ ގުޅިގެން ހޯދި ހޯދުންތައް އާންމުކުރުމަށާއި، އޭގެ ތެރޭގައި ބިދޭސީން ދިރިއުޅޭ ތަންތަނުގައި ހުރި އިންސާނީ ހައްގުތަކާ ގުޅޭ ނުރައްކާތަކާއި، އެކަންކަން ހައްލުކުރުމަށް އަޅަންޖެހޭ ފިޔަވަޅުތައް ހާމަކުރުމަށް.
ދައުލަތާއި ކަމާބެހޭ ރެގިއުލޭޓަރީ އިދާރާތަކުން، “ބިދޭސީ މަސައްކަތްތެރިން ދިރިއުޅޭ ތަންތަނުގެ މިނިމަމް ސްޓޭންޑަޑް ކަނޑައެޅުމުގެ ގަވާއިދު” (2021/R-15) އާއި “މަސައްކަތުގެ މާހައުލުގެ ސަލާމަތާއި ސިއްހީ ރައްކާތެރިކަމުގެ ގާނޫނު” (2/2024) އަށް އަދި ބިދޭސީ މަސައްކަތްތެރިންގެ ދިރިއުޅުމުގެ ހާލަތު މޮނީޓަރ ކުރުމުގެ ގަވާއިދުތަކަށް އަމަލުކުރާ މިންވަރު ދެނެގަނެ މުރާޖަޢާކުރުމަށާއި، އިހުމާލުވާ ވަޒީފާދޭ ފަރާތްތަކާ މެދު ފިޔަވަޅު އެޅުމަށް.
ދައުލަތުން ބިދޭސީ މަސައްކަތްތެރިންގެ ސަލާމަތާއި ރައްކާތެރިކަމަށް އިސްކަންދީ، ރާއްޖޭގައި މަސައްކަތްކުރާ ހުރިހާ މަސައްކަތްތެރިންނަކީ ވެސް އެމީހުންގެ ފުރާނައަށް ނުރައްކާނުވާ ފަދަ އަސާސީ ދިރިއުޅުމުގެ މިންގަނޑުތައް ފުރިހަމަވެފައިވާ ތަންތަނުގައި އުޅޭ ބަޔަކުކަން ކަށަވަރުކުރުމަށް އަމަލީ ފިޔަވަޅުތައް އެޅުމަށް.
ކަމާބެހޭ އިދާރާތަކުން، ސަލާމަތީ މިންގަނޑުތަކަށް ހޭލުންތެރިކުރުވުމާއި ތަމްރީނު ޕްރޮގްރާމްތައް މެދުނުކެނޑި ހިންގައި، ރާއްޖޭގެ އެކި ކަންކޮޅުތަކުގައި ބިދޭސީން ދިރިއުޅޭ ތަންތަނުގެ ރައްކާތެރިކަން ވަރުގަދަކުރުމަށް.

Joint Press Statement: Dhigurah fire highlights failures in enforcement of safety standards in migrant worker accommodations

The undersigned organizations express deep concerns over the recent fire in a migrant workers’ accommodation in ADh.Dhigurah, which resulted in the loss of five lives while two others remain in critical condition and are currently on ventilator support. We extend our sincere condolences to the families of the victims and all those affected.

This incident is part of a troubling pattern in which migrant worker safety is consistently overlooked, and those responsible for ensuring safe living and working conditions face little accountability. As a result, migrant workers’ basic rights to life, safety, and dignity continue to be violated in a system where justice is rarely delivered. The risks faced by migrant workers living in congested accommodations became tragically clear in 2022, when a deadly fire in Malé killed 10 migrant workers housed above a garage in cramped, poorly ventilated quarters. In 2024, the Gaamagu Café fire displaced over 50 migrants, with 57 people affected as the blaze spread into upper-floor living areas. Earlier, in 2023, the Neelan Fihaara fire destroyed an accommodation block and displaced 166 migrant workers. Apart from these, there have still been fires in other migrant worker accommodations and workplaces across the Maldives, underscoring ongoing safety and oversight concerns.

Migrant workers are often housed in overcrowded and inhumane conditions in tightly packed rooms without access to adequate sanitation. They are also frequently being housed in spaces unfit for human habitation, including unsafe building sites, mixed-used buildings such as small spaces above garages, cafe’s, storage areas or workplaces containing hazardous equipment and industrial substances.

The Regulation on Minimum Standards for Accommodation of Expatriate Employees (R‑15/2021) sets out clear requirements on habitability, ventilation, occupancy limits, sanitation, including provisions on fire prevention and emergency response, such as adequate fire safety equipment, clearly accessible escape routes, and measures to reduce fire hazards within the accommodation. The Occupational Safety and Health Act (Law No.2/2024) similarly impose obligations to prevent hazards and ensure safe environments. However, poor implementation, weak monitoring and enforcement measures have allowed non‑compliant and undignified accommodation to remain widespread, placing migrant workers at continued risk of injury and death.

All workers are entitled to safety, dignity, and justice, yet repeated incidents show that their rights are often neglected, and accountability is rarely enforced. The State and employers have a clear responsibility under national and international law to ensure that all workers live and work in safe conditions. Justice means safeguarding migrant workers’ rights, prosecuting violations, providing real remedies, and putting effective measures in place to stop similar incidents in the future.

We urgently call on:

Relevant authorities including the Maldives Police Service (MPS) to conduct a credible and transparent investigation into the fire in Dhigurah, examining both the causes of the incident and the extent of compliance with required accommodation and safety checks.
The State and relevant bodies ensure that the families of the victims receive full and just compensation, and that all associated costs are covered without delay.
The State and relevant bodies to ensure that all individuals or entities responsible for negligence are held fully accountable through appropriate legal action.
The Labour Relations Authority (LRA) proactively monitor migrant‑worker accommodations, prioritising high‑risk areas and taking prompt enforcement action wherever safety or accommodation standards are violated.
The Human Rights Commission of the Maldives (HRCM) to publicly disclose its findings on the incident, including any human‑rights risks identified in migrant‑worker accommodation, along with the follow‑up measures required to address them.
The State and relevant regulatory bodies to review compliance of The Regulation on Minimum Standards for Accommodation of Expatriate Employees (R‑15/2021) and the Occupational Health and Safety Act (Law No.2/2024) along with the existing procedures for monitoring migrant‑worker living conditions, and to take action against employers and other responsible parties found negligent or in violation of safety and accommodation standards.
The State to prioritize and take concrete steps for the safety and wellbeing of migrant workers, ensuring that all workers in the Maldives have access to basic living and working conditions that do not place their lives at risk.
Relevant agencies implement ongoing awareness and training programs aimed at improving compliance with safety standards and strengthening protections in migrant‑worker accommodations across the country.
